Up to three days without a certificate of incapacity for work. The certificate of incapacity for work must be available on the 4th day. Exception: the employer requires the certificate of incapacity for work from the first day. Description Illness with inability to work The employee is obliged to inform the employer immediately of the incapacity for work and its expected duration. If the incapacity for work lasts longer than three calendar days, the employee must submit a medical certificate confirming the existence of the incapacity for work and its expected duration to the employer on the following general working day at the latest. If the incapacity for work lasts longer than stated in the certificate, the employee is obliged to submit a new medical certificate. Limited ability to work Limited ability to work can be certified by the company doctor. Persons with infectious diseases of the skin and mucous membranes may not be employed in the CSSD for the duration of the illness (even if these illnesses do not cause incapacity to work). In the case of persons who are carriers of pathogenic or multi-resistant microorganisms (e.g. Salmonella, VRE, MRSA), it must be decided on a case-by-case basis whether it is possible to work at the workplace or at another workplace in the hospital (consultation with the company doctor and the hospital hygiene department). In such cases, the employee is obliged to inform the head of the HR department immediately about the illness.
